Top Subprime Mortgage Firm Accused of Abuses | #WaccabucRealEstate

 

The nation’s largest servicer of subprime mortgages has engaged in abuses that could potentially harm hundreds of thousands of borrowers, according to the New York Superintendent of Financial Services.

The state regulator issued a letter Tuesday to Ocwen Financial Corp., documenting many of the same kinds of abuses that worsened the housing crisis and the Great Recession.

Ocwen inappropriately backdated foreclosure warnings and letters that denied mortgage loan modifications, making it nearly impossible for borrowers to appeal the company’s decision, according to the letter from Benjamin Lawsky, New York’s Superintendent of Financial Services.

Many borrowers who had fallen behind on their payments also received warning letters months after the deadline for avoiding foreclosure had already passed.

The agency also determined that Atlanta-based Ocwen failed to investigate the backdating of its letters to borrowers nearly a year after an employee raised questions about the practice.

“The existence and pervasiveness of these issues raise critical questions about Ocwen’s ability to perform its core function of servicing loans,” Lawsky wrote in the letter.

The letter refrains from saying whether the backdating was intentional or the result of poor oversight by Ocwen.

In a statement Tuesday, Ocwen blamed software errors in the company’s correspondence systems for the improperly dated letters to at least 281 of its borrowers in New York who received letters with incorrect dates.

The company added that it is investigating two other cases and cooperating with New York’s Financial Services department.

“We believe that we have resolved the letter-dating issues that have been identified to date, and we continue our investigation as to whether there are additional letter-dating issues that need to be resolved,” the company said.

Lawsky launched a probe into Ocwen in August amid allegations that Ocwen overcharged struggling homeowners on a product called force-placed insurance, which servicers force borrowers to buy if they don’t maintain voluntary homeowners’ insurance.

If mortgage borrowers don’t pay up for newly purchased insurance, Ocwen forecloses on their homes.

US pending home sales rebound | #Waccabuc Real Estate

 

US pending home sales rebounded last month to their highest levels in nearly a year, the National Association of Realtors said Thursday, in report providing further evidence of a steadying housing market.

The NAR’s pending home sales index surged 3.3 percent in July to 105.9, its highest level since August 2013.

The increase in the forward-looking indicator, which is based on contract signings, came in much stronger than expected. The average estimate was for a modest 0.5 percent rise.

Pending home sales have climbed in four of the past five months. The June decline in pending home sales was steeper than first thought, with the drop revised to 1.3 percent from 1.1 percent.

Lawrence Yun, NAR chief economist, said that favorable housing conditions spurred increased contract activity last month.

“Interest rates are lower than they were a year ago, price growth continues to moderate and total housing inventory is at its highest level since August 2012,” he said.

“More importantly, steady job additions to the economy are helping family finances and giving them added confidence to enter the market.”

This man pretends to be a Realtor and no one can stop him | Waccabuc Real Estate

 

The Real Estate Council in Alberta, Canada, seems to have a real problem on its hands with real estate agent Derek Johnson.

The regulatory authority is not bothered by his claims on YouTube.

Nor is it his system that will reportedly threaten the Multiple Listings Service in Calgary.

It’s that Derek Johnson doesn’t seem licensed to conduct business as a real estate agent and broker.

But that’s not stopping Johnson.

According to CBCnews, the Real Estate Council keeps fining Johnson for not having a license.

The penalties are growing from $15,000 to $50,000.

Furthermore, there are reports claiming Johnson is committing fraud and harming homeowners.

And, according to an email Johnson sent to CBCnews, it doesn’t look like he plans to stop:

“Johnson said in an email that the fines are ridiculous and he hasn’t been given due process by the Real Estate Council of Alberta.

Homeownership at near 20-year low, but some bright spots | Waccabuc Real Estate

Despite low interest rates and expanding credit availability, homeownership in the U.S. continues to fall, down to a low of 64.7%, a level not seen since 1995.

Among the key culprit is home affordability, which has been exacerbated by home price appreciation driven by investor and not owner-occupant sales and general wage stagnation.

“The fundamental causes of the decreasing homeownership trend are becoming more entrenched and are not expected to reverse anytime soon,” says Ron D’Vari, CEO, NewOak.

Further stressing the problem, first-time home purchasers are declining as a share of total home sales.

Usually, first-time home buyers constitute one of the major drivers of the homeownership rate of change, but tougher mortgage underwriting standards, lower quality of new jobs and changing demographics are keeping them renting instead of buying.

“College graduates are not qualifying for new home purchases as many of them are burdened with student loan repayments as well as the higher down-payment requirements. As a result, first-time homebuyers are failing the qualified mortgage/qualified residential mortgage and ability-to-repay rules,” D’vari says. “Unless home prices rise at a much slower pace and the U.S. economy produces more higher-paying jobs and regulators loosen up the mortgage lending rules, the downward trend in homeownership is unlikely to reverse course any time soon.”

China Price Declines Spreading as Buyers in Less-Developed Cities Hold Back | Waccabuc Real Estate

 

China’s housing prices fell in May for the first time in nearly two years, as fresh data indicate more cities with price declines and weaker sales.

Average new-home prices fell 0.3% in May from April, a turnaround from the 0.1% monthly gain recorded for April and the first decline since June 2012, data provider China Real Estate Index System said.

Year to year, average new-home prices rose 7.8% in May, decelerating for the fifth straight month, after April’s 9.1% increase and March’s 10% rise, CREIS said, citing data from its survey of 100 Chinese cities.

Prospects for China’s property market, an important engine of growth for the country’s economy, are souring. More Chinese cities recorded a month-to-month fall in housing prices in May. Out of the 100 Chinese cities surveyed, 62 showed a decline in home prices, compared with 45 in April.

Many home buyers outside more-developed cities, such as Shanghai and Beijing, have shied away from the market in anticipation of further price cuts and difficulties in getting mortgages.

“We almost became home-mortgage slaves last week,” said Ou Yibao, a 29-year-old software engineer in Shenzhen, using a term for those paying off mortgages on expensive homes.

Mr. Ou, who told The Wall Street Journal two years ago that he was opposed to buying a home, said he was succumbing to family pressure to make the leap. But after realizing housing prices may fall, he said this week that he pulled back on the purchase of a 90-square-meter (969 square feet) apartment. “We tore up the contract,” he said.

From Queasy Colors to Killer Tables: Your Worst Decorating Mistakes | Waccabuc Real Estate

 

I recently wrote an article for Houzz in which I acknowledged the dumbest decorating decisions I’d ever made. More than 300 of you responded with your own tales of woe. Most of them fell into four categories:

1. Painting anything yellow.
2. Furniture that wouldn’t fit through doorways.
3. Leaving town while someone worked on your home.
4. Painting anything yellow.

Zillow, Trulia and realtor.com strengthen their hold on consumers | Waccabuc Real Estate

 

Zillow, Trulia and realtor.com captured more than a third of all visits to real estate sites from desktop computers in April for the first time.

Real estate’s three largest portals have been slowly growing their overall real estate Web traffic share from desktop computers for at least the last 18 months, according to Experian Marketing Services data.

(Unlike its digital analytics competitor comScore, Experian measures Web traffic by total visits rather than unique visitors and currently does not report traffic from mobile devices or mobile apps. See recent Inman News story analyzing comScore March data).

Zillow, Trulia and realtor.com captured 34.4 percent of the 360 million visits to real estate sites last month – 8.2 percentage points above their collective Web market share in April 2013.

As it has for the last few months, Zillow came in at No. 1 by a wide margin, capturing 17.39 percent of desktop traffic in April, nearly twice the desktop traffic of Trulia and more than twice that of realtor.com.

Clinton Hill Mansion Owned by Two Ex-Mayors Wants $9.875M | Waccabuc Real Estate

William Tubby built the house for Brooklyn mayor Charles A. Schieren before Brooklyn and Manhattan were consolidated and, according to rumor, Prohibition-era mayor Jimmy Walker also lived in the house for a time. There’s a lovely library with floor-to-ceiling shelves, a living room with “a hidden projector screen,” six wood-burning fireplaces in total, and a massive backyard and patio. It kind of looks like a less-whimsical/cluttered version of that house from The Royal Tenenbaums. Last year, it hit the rental market for $14,000/month, but now it’s looking to sell for an impressive $9.875 million.
